Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The petitioner is brother of the informant. For land dispute, an occurrence of assault took place wherein specific allegation against the petitioner is that he caused injury with iron rod at the chest of the wife of the informant. Others also assaulted as a result whereof wife of the informant died. The Doctor has found head injury as cause of death which is not attributable against the petitioner.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees
Patna High Court Cr.Misc. No.1070 of 2018 (5) dt.14-03-2018 2/2 Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barari Police Station Case No. 75 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
