The petitioner apprehend their arrest in G.O.Case No.344 of 2014 registered under Section 33 of the Indian Forest Act. The complainant alleged that while complainant and other patrolling, both the petitioners were found constructing house over plot No.3022 of Khata No.339. The aforesaid land has already been notified under the Forest Act.
The learned counsel for the petitioner submits that the petitioner were not constructing any house on the forest land and they have been falsely been implicated in the case. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the
Patna High Court Cr.Misc. No.271 of 2018 (2) dt.15-01-2018 2/2 event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with in G.O. Case No.344 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
