JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 644 of 2017, disclosing offences under Sections 498A, 420 and 379 of the Indian Penal Code. Petitioner happens to be husband of the complainant and allegation against him is of demand of dowry of Rs. Two Lakh and other articles and for that subjecting the complainant to torture.
Submission of learned counsel for the petitioner is that prior to lodging this case, petitioner has filed matrimonial divorce suit against the complainant and, thereafter, the present case has been filed and now the matrimonial case has also been decided in favour of petitioner and divorce decree has been

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka, in connection with Complaint Case No. 644 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
