JUSTICE ALOK KUMAR PANDEY ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 16-12-2025 The present writ application has been filed in the form of a Public Interest Litigation (PIL) for the following relief:
"1. That this writ application by way of Public Interest Litigation is being filed for issuance of Writ of Mandamus directing the Respondent No.1 and 3 i.e., Additional Chief Secretary Revenue and Land Reform, Bihar, Patna and the Collector, Siwan to dispose off the representation dated 29.05.2024 as contained in Annexure-P 2 of this application, filed for compliance of recommendation dated 03.07.2023 given by the Chairman, State Schedule Tribe Commission,
Patna High Court CWJC No.17231 of 2024(8) dt.16-12-2025 2/3 Bihar, Patna by which it was recommended to open a residential school for Schedule Tribe Class children in Circle - Siswan, Halka- Raipur, MaujaDera ka Bangra, Khata No.- 164, Khesara No.- 606, Aria- 11 Bigaha 12 Kattha in which 5 Akad, Type of land - Gaiur Mazarua khash land in District- Siwan so that population of eighty seven thousand Schedule Tribe Children may get their proper education.
The petitioner also prays for the issuance of writ/writs, direction/directions, order/orders in her favor in the facts and circumstances of this case."
2. A counter affidavit has been filed on behalf of respondent No. 3, the relevant paragraphs of which are extracted hereinbelow:
"11. That it is pertinent to bring on record that at present the answering respondent i.e. the Department of Schedule Caste and Scheduled Tribe Welfare is running 25 residential schools with an overall capacity of 11,600 students in 9 different districts. Additionally, the answering respondent is also running 66 different schools in 38 different districts for Schedule Caste students.
13. That further, to cater the Scheduled Tribe students in other Blocks and Districts the answering respondent devised a policy which was communicated to all the concerned stakeholders vide Letter No. 3966 dated 28.06.2023 by the Secretary, SC/ST Welfare Department wherein it has been
Patna High Court CWJC No.17231 of 2024(8) dt.16-12-2025 3/3 categorically decided that in all the "Dr. Bhim Rao Ambedkar Residential School for Schedule Caste students, 10% seats shall be reserved for Scheduled Tribe students and vice-versa and only in case where the seats are vacant, seats shall be registered by the Schedule Caste students."

Upon consideration of the statements made in the counter affidavit, it is evident that the issue raised in the writ application relates to a policy decision taken by the Department of Scheduled Caste and Scheduled Tribe Welfare, which takes into account several factors, including the population of Scheduled Tribe students in the concerned areas.
4. In view of the aforesaid facts and circumstances, we find no reason to pass any further order in the present matter.
5. Accordingly, the present writ application stands disposed of.
6. Pending application(s), if any, shall stand disposed of.
