Petitioners apprehend their arrest in Turkauliya (Raghunathpur) P.S. Case No.204 of 2019 registered under Sections 147, 148, 149, 341, 323, 307, 332, 333, 353 of the Indian Penal Code and under section 27 of the Arms Act. The informant alleged that on secret information the police force went to arrest Chandan Ram, accused of Turkauliya (Raghunathpur) P.S. Case No.30 of 2019 and surrounded the house of Chandan Ram but Chandan Ram and his associates made indiscriminate firing on the police force. While Chandan Ram was fleeing from his house, he was apprehended and from his possession one automatic loaded pistol with magzine

Patna High Court CR. MISC. No.67156 of 2019(2) dt.24-10-2019 2/2 containing four live cartridges were recovered. Learned counsel for the petitioners submits that the petitioners are father and brother of Chandan Ram. The petitioners were not even present in the house. The petitioners have falsely been implicated in the case.

Having considered the facts and the nature of allegation made against the petitioners and the fact that the petitioners are father and brother of Chandan Ram, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Turkauliya (Raghunathpur) P.S. Case No.204 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
