JUSTICE BIRENDRA KUMAR ORAL ORDER 23-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 328,302/34 of the Indian Penal Code.

According to FIR, three persons including the petitioner entered into the house of the informant and in the room, dead body of the daughter of the informant was noticed. The informant suspected that the petitioner and others have poisoned her to death.

Learned counsel for the petitioner submits that the matter is of commission of suicide by the victim herself and false implication is there just to pressurize. Coaccused Dharambir Kumar has already been allowed bail by

Patna High Court Cr.Misc. No.2247 of 2018 (5) dt.23-04-2018 a Coordinate Bench of this Court vide Annexure-5 considering the material on the record aforesaid as well as compromise of the case between the parties.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sigori Police Station Case No.14 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
