Petitioner is apprehending arrest in connection with Doriganj P.S. Case No. 101 of 2017 for an offence under sections 147, 148, 149, 341, 353, 332, 307, 427 and 283 of the Indian Penal Code.
Mr. Shekhar Singh, learned Sr. counsel appearing on behalf of the petitioner submits that petitioner is one of the members of the mob who protested and caused traffic jam. In the instant case FIR was registered by the police. There is no specific overt act except the fact that the petitioner was a member of the mob who was found involved in protesting and causing disturbance in smooth movement of traffic and disturbing peace and tranquility.
Patna High Court Cr.Misc. No.6040 of 2018(3) dt.27-02-2018 2/2 Petitioner has stated in para-3 that he has no criminal antecedent.
Considering the fact that there was no overt act alleged against the petitioner and there was only omnibus allegation that petitioner was one of the members of the mob, let the petitioner, named above, be released on bail in the event of arrest/surrender before the court below within a period of one month from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran, Chapra, in connection with Doriganj P.S. Case No. 101 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
