JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Turkaulia (Raghunathpur) P. S. Case No. 204 of 2019, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 332, 333, 353 of the Indian Penal Code and Section 27 of the Arms Act.
Although petitioner is named in the first information report but no specific overt-act has been attributed against her. Submission on behalf of the petitioner is that petitioner has been made accused in this case only being mother of co-accused Chandan Ram and moreover, father and brother
Patna High Court CR. MISC. No.66918 of 2019(2) dt.27-11-2019 2/2 of co-accused Chandan Ram have already been admitted to anticipatory bail by a co-ordinate bench of this court, vide order, dated 24.10.2019, passed in Cr. Misc. No. 67156 of 2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of her arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Motihari in connection with Turkaulia (Raghunathpur) P. S. Case No. 204 of 2019, subject to conditions as laid down under Section 438(2) of the CrPC.
