JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Bhwanipur P.S. Case No. 105 of 2018, dated 12.05.2018, instituted for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.
During a marriage ceremony, the petitioner is alleged to have opened fire in an intoxicated state, leading to minor injuries to the grand daughter of the informant in her elbow.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.42059 of 2018 (2) dt.20-07-2018 2/3 that the informant of this case is directly related to the petitioner as well. During a marriage ceremony, the petitioner and others had arranged for garlanding of the bride and the groom which was not to the liking of the elder persons of the society including the informant. Because of the insistence of the petitioner and others, such a ritual was followed.
The grand daughter of the informant got injured in another manner, which becomes evident from a look at the injury report. There is a simple lacerated injury in the elbow of the grand daughter of the informant and the opinion with respect to the nature of injury and the weapon used could not be ascertained and an expert opinion has been called for.
Considering the aforesaid facts, viz. the nature of injuries suffered by the grand daughter of the informant as also taking into account that petitioner does not have any criminal antecedent, this Court is inclined to enlarge him on anticipatory bail.
Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.42059 of 2018 (2) dt.20-07-2018 3/3 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Purnia in connection with Bhawanipur P.S. Case No. 105 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
