The petitioner is apprehending his arrest in connection with Rajpur P.S.Case No.101 of 2019 registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per FIR, there is allegation of recovery of 720 ml. of liquor from the Hotel of the petitioner and he is accused in one more such type of case.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and he was not present there.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of

Patna High Court CR. MISC. No.64712 of 2019(2) dt.16-10-2019 2/2 with a direction to the petitioner to surrender er before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid direction, this application is disposed of.
