The petitioner apprehends arrest in a case registered for the offence punishable under sections 353, 427, 34 of the Indian Penal Code and section 4/6/10 of Bihar Conduct of Examination Act, 1981.

As per the prosecution case, this petitioner and other accused persons threw their question papers and torn OMR sheets and thus they created ruckus at the Examination center. Learned counsel for the petitioner submits that as a matter of fact students were agitated as the questions were out of syllabus and account of which ruckus was created at the center and while fleeing Aadhar card of the petitioner fell down near the center. Patna High Court CR. MISC. No.74484 of 2022(2) dt.06-04-2023 2/2 allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 38808 of 2022. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Banka in Banka Police Station Case No. 204 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
