2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. The case of the prosecution is that altogether 140 liters of country made liquor was recovered from a E-rickshaw.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that the petitioners are neither the owner nor the driver of that E.Rickshaw rather their name has surfaced on the basis of the

Patna High Court CR. MISC. No.70751 of 2025(2) dt.08-10-2025 2/2 confessional statement of co-accused person. It is further submitted that nothing has been recovered from the conscious possession of this petitioners. Moreover, the petitioners are languishing in judicial custody since 06.08.2025. 5.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail stating that both the petitioners have criminal antecedent of one case in which they are on bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Amas P.S. Case No. 242 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge, Court No. -5, Gaya.
