Petitioner seeks bail in connection with Shikarpur P.S. Case No. 440 of 2018 registered for the offence punishable under sections 21(b), 22(b), 23(b) of the N.D.P.S. Act and Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no criminal history. Petitioner is in custody since 27.11.2018. Similarly situated co-accused persons have been granted bail by
Patna High Court CR. MISC. No.65648 of 2019(2) dt.22-10-2019 2/2 different co-ordinate Benches of this Court vide orders contained in Annexure-2 series.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, West Champaran at Bettiah in connection with Shikarpur P.S.
