Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 307, 302 and 120(B)/34 of the Indian Penal Code.
As per the prosecution case, the accused persons including these petitioners entered into the house of the informant and on the orders of accused Meena Devi to kill, all the accused persons dragged the deceased Jitendra Sah and injured Abhishek Kumar. Petitioner no. 3 inflicted Khukhri blow
Patna High Court CR. MISC. No.1814 of 2023(3) dt.08-05-2023 2/2 to Abhishek Kumar causing open head injury.
Learned counsel for the petitioners submits that the parties are close agnate and there is land dispute between them. Doctor has found simple injury. The petitioner has got no criminal antecedent.
Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist, Muzaffarpur in connection with Sahebganj P.S. case no. 271 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
