In this case, the petitioner is seeking anticipatory bail in connection with Singheshwar P.S. Case No.31 of 2018, registered for the offence punishable under Section 7 of the E.C. Act.

The Police has intercepted and seized a vehicle loaded with Arva rice on suspicion that the said rice was meant for distribution to the poor persons.

Learned counsel for the petitioner submits that the petitioner is the owner of the vehicle and the rice was not meant for the distribution to the poor persons, rather it was purchased and the rice was to deliver at Saharsa.

No.43286 of 2018(2) dt.20-07-2018 2/2 Considering the aforesaid facts and circumstance of the case, let the petitioner, namely, Srimati Kiran Devi @ Kiran Devi, be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Singheshwar P.S. Case No.31 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, she will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
