The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 498(A), 304(B), 201/34 of the Indian Penal Code.
Allegation against the petitioner and other coaccused persons is that they killed the sister of informant and concealed the dead body of informant's sister due to non fulfillment of dowry demand. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.76684 of 2023(3) dt.22-01-2024 2/3 petitioner that the petitioner is innocent and being the husband of the deceased, he has falsely been implicated in the present case. It is also submitted that deceased died due to her illness, during the course of treatment and informant along with his family members and covillagers of the petitioner has participated in the funeral of the deceased. There is no prior complaint of harassment and torture. Moreover, the petitioner is languishing in judicial custody since 22.06.2023. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Desri P.S. Case No. 173 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to
