The petitioner seeks bail in connection with Dawath P.S. Case No. 138 of 2019 for the offence under Sections 30(a)nof the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 64283 of 2019 and the case of this petitioner stands of similar footing. The petitioner is rotting in judicial custody

Patna High Court CR. MISC. No.64864 of 2019(2) dt.24-10-2019 2/2 since 28.08.2018. Hence, the petitioner may be enlarged on regular bail.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge -cumSpecial Judge, Excise, Rohtas at Sasaram in connection with Dawath P.S. Case No. 138 of 2019.
