The petitioner is in custody since 29.07.2019 in connection with Dhaka (Pachpakri) P.S. Case No. 235/19 registered for the offence punishable under Sections 30(a)/41(2) of the Bihar Liquor Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession, but from the house of one Anuj Chaudhary and Omprakash Chaudhary and that the petitioner has nothing to do with the same. Learned counsel for the petitioner submits that apart from one other case under the Excise Act in which the petitioner

Patna High Court CR. MISC. No.73256 of 2019(3) dt.25-11-2019 2/2 was subsequently implicated, the petitioner has already been granted bail vide order dated 24.10.2019 passed in Cr. Misc. No. 67971 of 2019.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge under Excise Act, East Champaran, Motihari, in connection with Dhaka (Pachpakri) P.S. Case No. 235/19.
