JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2018 The petitioner is apprehending his arrest in connection with Pachrukhi P.S. Case No. 04/18, registered for offences punishable under Sections 406, 409 and 34 of the Indian Penal Code.

Allegation against the petitioner is of excess withdrawal of Rs.3,55,724/- and with interest it comes to Rs.5,47,815/-. Submission of learned counsel for the petitioner is that he has come before the Hon'ble High Court against the order of the authority concerned in C.W.J.C. No. 3695 of 2018 and the Hon'ble Court has been pleased to direct the petitioner to move before the authority concerned afresh, who will do the fresh measurement and calculation and in such view of the matter, the

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of six weeks and on surrender the court below shall release the petitioner on provisional bail to his own satisfaction till submission of charge-sheet and if after submission the case against the petitioner is found to be true, he will have to surrender before the court below.

It is made clear that the petitioner shall cooperate in the investigation and shall appear before the investigating officer as and when required by him along with all the relevant papers. (Vinod Kumar Sinha, J) sunil/-amjad U T
