The petitioners apprehend their arrest in Saharsa Sadar P.S. case No. 49 of 2018 under Sections 341, 447, 323, 308, 379, 504, 506 and 34 of the Indian Penal Code. The informant alleged that both the petitioners, husband and wife entered into his house and petitioner no. 1, Lal Bahadur Bhagat indiscriminately assaulted the informant with iron rod on the head, right soldier and back. The informant got head injury. The informant further alleged that both the accused persons indiscriminately assaulted him all over his body. Lal Bahadur Bhagat also snatched money from his pocket.
The learned counsel for the petitioners submits that the informant alleged that both the petitioners indiscriminately

No.42369 of 2018 (2) dt.20-07-2018 2/2 assaulted him all over his body but from perusal of the injury report, annexed as Annexure-2, it appears that informant got only one lacerated wound that too superficial and simple in nature. No other injury was found on person of informant. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. case No. 49 of 2018 subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
