JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This application, for grant of anticipatory bail, arises out of Allouli P.S. Case No. 269 of 2018, disclosing offences under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per F.I.R., there is allegation against petitioner and one co-accused of firing on the informant causing injury to him. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case in the background of land dispute and Annexure - 2, which is injury report does not show any fire arm injury on the persons of the informant and co-accused of this case has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 27.06.2019 passed in Cr. Misc. No. 38400/2019.

Having heard both sides, in view of above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Allouli P.S.
