Mr. Sanjay Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 3(5) and 303(2) of the B.N.S..
3. As per prosecution case, informant, namely Mahesh Paswan, alleged that on 05.06.2025 at about 8 o'clock, after Dwar Puja, all the family members of the informant were going to perform the ritual of Barnet, in the meantime, 25 to 30 unknown persons attacked them and looted jewelleries and cash and also assaulted them. Through the help of local people, they came to know that all the F.I.R. named accused persons,
Patna High Court CR. MISC. No.73161 of 2025(2) dt.18-11-2025 2/3 including these petitioners and 20 to 25 unknown persons were involved in the alleged occurrence.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Informant has not disclosed the source of information as to who disclosed the name of these petitioners, which itself makes the entire prosecution case doubtful. Allegations are general and omnibus. No looted article were recovered from possession of these petitioners.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and the fact that no looted articles were recovered from possession of these petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in
Patna High Court CR. MISC. No.73161 of 2025(2) dt.18-11-2025 3/3 connection with Bhagwanpur Hat P.S. Case No. 239 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
