The petitioner has renewed his prayer for bail in a case registered under sections 302 and 201 of the Indian Penal Code and section 27 of the Arms Act.

The earlier prayer for bail of the petitioner was rejected vide order dated 3.3.2022 (Annexure-1) passed in Cr. Misc. no. 46217 of 2021.

It is submitted by learned counsel for the petitioner that the petitioner has denied having any relationship with the deceased. He has no concern with the alleged victim. He is in custody since 22.1.2021 and undertakes to cooperate in the trial. He has no criminal antecedent.

Heard learned APP for the State.

Patna High Court CR. MISC. No.71465 of 2022(3) dt.18-01-2023 2/2 A report was called for from the learned trial Court. As per the report received contained in letter dated 2.1.2023, the case is at the stage of prosecution evidence. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, the stage of the trial as is evident from the report received from the learned trial Court contained in letter dated 2.1.2023 together with the petitioner having remained in custody for about 2 years since since 22.1.2021, the Court directs the petitioner to be enlarged on bail in connection with S.Tr. no. 50/2022 (arising out of Karamchat P.S. Case no. 11 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III, Kaimur at Bhabua.
