The petitioner apprehends his arrest in connection with Kotwali P.S. Case no. 220 of 2017, registered under Sections 341, 342, 323, 386, 411, 504 and 506/34 of the Indian Penal Code.

The accusation is that on 11.05.2017, informant Prabhu Kumar Gaur went to the Passport office situated at Maurya Lok Complex, Patna, where 5 to 6 persons were present near the stair of the said office, who made query regarding the work then informant replied that he came there for inquiry then the aforesaid persons demanded Rs. 2000/-, but informant was not ready to pay the same amount and also tried to call his villager, who used to reside at Patna, but they snatched his mobile and also tried to snatch money, but anyhow

Patna High Court Cr.Misc. No.42510 of 2018(2) dt.20-07-2018 2/2 informant saved him and entered in the Passport office. Thereafter, Police came there and two persons were apprehended, who disclosed their names as Binay Yadav and Bishu Deo Prasad Verma. The apprehended persons disclosed the name of this petitioner and others as their associates. Learned counsel for the petitioner submits that petitioner has not been apprehended on the spot, rather, his name has been disclosed by the co-accused Binay Yadav and Bishu Deo Prasad Verma, who where apprehended on the spot by the Police. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 220 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
