The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 380, 447, 506, 504/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including the petitioner assaulted the informant and his son by means of knife, leg and fat, due to which they sustained injuries and they also took away Rs.50,000/- and gold chain from the neck of informant's son.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.8.2019 and has got no criminal antecedent. There is no allegation of tampering of

Patna High Court CR. MISC. No.68380 of 2019(2) dt.25-10-2019 2/2 witnesses alleged against the petitioner. Both the parties are agnates. The nature of injury is said to be simple. Hence, no offence under Section 307 of the I.P.C. is made out. At best, it is a case for an offence under Section 324 of I.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Ghorasahan (Lakhaura) P.S. case No.208 of 2019.
