JUSTICE BIRENDRA KUMAR ORAL ORDER 20-07-2018 The order of the court below dated 02.10.2017 would reveal that petitioner Randhir Yadav was remanded to custody on 02.10.2017 itself in connection with G.R. Case No.6210 of 2017, arising out of Buddha Colony Police Station Case No.342 of 2017.

However, while considering the prayer for bail of the petitioner this Court noticed that in the impugned order dated 18.01.2018 passed in B.P. No.3139 of 2017 by the learned Additional Sessions Judge-7th, Patna, the date of custody is mentioned as 05.12.2017. Accordingly, in the order dated 17.02.2018 passed in Criminal Miscellaneous No.9315 of 2018, whereby the bail was granted to the petitioner on completion of nine months of custody, the date of custody is mentioned as

Patna High Court Cr.Misc. No.42796 of 2018(2) dt.20-07-2018 2/2 05.12.2017. The mistake is typographical one. Hence let the period of custody of petitioner be treated from 02.10.2017. The order dated 17.02.2018 stands modified to the aforesaid extent.
