2. This application, for grant of anticipatory bail, arises out of Mufassil (Samastipur) Police Station Case No. 230 of 2020, disclosing offences under Sections 341, 323, 324, 326, 307, and 120B of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the First Information Report, the petitioner, along with other co-accused persons, said to have fired upon the informant due to which he sustained firearm injury on his leg and waist. This is the second attempt for grant of anticipatory bail by the petitioner inasmuch as earlier anticipatory bail of the petitioner was rejected by this Court vide order dated
Patna High Court CR. MISC. No.76660 of 2024(2) dt.18-11-2024 2/2 28.02.2022 passed in Cr. Misc. No. 13913 of 2021 on merit.
4. Learned Counsel for the petitioner submits that this second anticipatory bail application has been filed on the basis of compromise arrived at between the informant and the petitioner.
5. Having considered the submissions made by the learned counsel for the petitioner and the State and taking into consideration the fact that compromise cannot be said to be subsequent event for consideration of second anticipatory bail, accordingly, I am not inclined to grant the petitioner privilege of anticipatory bail.
