====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 17-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner is apprehending his arrest in connection with Ratanpura P.S. Case No.41 of 2017 (Spl. Case No. 14 of 2017) for the offences registered under Section 20(b)/22 of the N.D.P.S. Act.

In the written report, it is alleged that near Koshi river in village- Parsahi at Indo-Nepal Border, 50 packets of Ganja containing 2 Kilogram each were recovered.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on the basis of the confessional statement of co-accused Ranjit Kumar Yadav. Nothing has been recovered from the possession of petitioner. It

Patna High Court Cr.Misc. No.47997 of 2018(2) dt.17-09-2018 2/2 has been further submitted on behalf of the petitioner that similarly placed co-accused, namely, Bechu Mehta and Vinod Kumar have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 33309 of 2018 and 31954 of 2018 vide order dated 16.07.2018 and 13.06.2018 respectively. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Supaul in connection with Ratanpura P.S. Case No. 41 of 2017 (Spl. Case No. 14 of 2017), subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
