====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

As per allegation as made in the F.I.R., the petitioner took away the informant's minor daughter namely, Guriya Kumari aged about 14 years from Naraha market with intention to get marry or to sell her. It has been also alleged that said minor daughter of the informant took away Rs. 35,000/- in cash and ornament.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.65628 of 2019(2) dt.14-11-2019 2/2 statement of the victim girl under Section 164 Cr.P.C. has been recorded in which she has stated that none kidnapped her and she voluntarily went to her elder sister's house. She has further stated that she want to go with her love Mukesh Kumar (petitioner).

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Suppi Police Station Case No. 58 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
