Perused the report submitted by the learned District & Sessions Judge, Bhojpur, Ara wherein the report of the learned Additional Sessions Judge-XVI, Bhojpur, Ara, who is conducting Sessions Trial No. 297 of 2019, is also annexed. From perusal of the report, it would be evident that out of 11 witnesses, 5 have already been examined. The last witness was examined on 16.03.2020 and, since then, the trial has not progressed because of the hindrance caused due to COVID-19 Pandemic.

The prayer for bail of the petitioner was earlier rejected by this Court twice.

2/3 Considering the gravity of the offence and the advanced stage of the trial, I am not inclined to grant bail to the petitioner for the present. The prayer for bail is rejected. In case, the trial is not concluded within nine months from today, the petitioner would be at liberty to renew his prayer for bail.

Since the court proceedings are being conducted through virtual mode and normal court functioning has not been restored till date, it is considered appropriate to adopt the following procedure for communication of the present order:- (i) The order, which has been dictated during the course of proceeding of the virtual court, shall be communicated to me on my email by the Sr. Secretary.

(ii) The corrected copy of the order shall be transmitted by me from my email id to the Sr. Secretary, which shall be treated to be an authentic copy of the order passed by this Court in the present proceeding.

(iii) Hard copy of the order duly signed by me shall be preserved in my residential office for documentation and future use, if any.

(iv) Let a copy of the order be sent to Mr. Ajit Kumar, learned counsel for the petitioner also on his email.

3/3 (v) Let steps be taken by the Sr. Secretary/registry for up- loading of the present order without compromising with the norms of social distancing.
