The petitioner seeks bail in connection with Sahebganj P.S. Case No. 337 of 2019 registered for the offences punishable under Sections 290, 414/34 of the Indian Penal Code and Section 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that the A.S.I., Narendra Kumar along with the police force departed for Gasti in the night and at Nawal Kishore Chowk, the police intercepted Magic Vehicle wherein two persons were sitting under intoxication. Seeing the police, they started making noise. On query, they disclosed their names as Guddu Kumar and Sumit

Patna High Court CR. MISC. No.65596 of 2019(2) dt.05-11-2019 2/2 Kumar. One quintal small iron Bars of 16 mm and 20 mm for use in road bridge as well as iron scrap of 1 x 1 feet were recovered from the Tata Magic. The driver disclosed his name as Shambhu Kumar. The petitioner also confessed that he is carrying stolen iron bars and scraps for selling. The petitioner is in jail custody since 06.08.2019. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent and no any case has been registered against the said stolen iron bars and scraps.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Sahebganj P.S. Case No. 337 of 2019.
