2. In the present case, the petitioners seek bail in connection with Barun P.S. Case No. 363 of 2025 registered for the alleged offences under Sections 126(2), 115(2), 352, 351(2), 109, 3(5) of B.N.S.
3. As per prosecution case, the petitioners and other co-accused persons claiming the land of the informant as their own and assaulted the husband and other family members of the informant making them unconscious.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this
Patna High Court CR. MISC. No.74681 of 2025(2) dt.20-11-2025 2/3 case. The petitioners and informant side are agnates and there is is land dispute which is apparent from the FIR. There is no specific allegation against the petitioners and the injury report of all three victims show simple injuries. There is no eye witness to the alleged occurrence. The petitioners are having no criminal antecedent. The petitioners are in custody since 24.07.2025 and charge sheet has been submitted.
5. Learned APP opposes the submission made on behalf of the petitioners.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the simple nature of injury of the victims in the light of non-specific allegation against the petitioners and further considering the period of custody of the petitioners, their clean antecedent and submission of charge sheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/concerned Court in connection with Barun P.S. Case No. 363 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :
Patna High Court CR. MISC. No.74681 of 2025(2) dt.20-11-2025 3/3 (i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
