JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 This application, for grant of anticipatory bail, arises out of Sheikhopur Sarai P.S. Case No. 56 of 2019, disclosing offences under Sections 147, 148, 149, 341, 307, 337 of the Indian Penal Code.

Allegation as per F.I.R. is that while the informant was going along with his brother, other accused persons surrounded him and on the order of Devendra Singh, Ravi kumar fired twice on the informant and it is alleged that petitioners were also present there.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.66785 of 2019(2) dt.23-10-2019 2/2 that they have falsely been implicated in this case and even according to F.I.R. there is no allegation against the petitioners of assaulting anyone.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Sheikhpura, in connection with Sheikhopur Sarai P.S. Case No. 56 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
