2. The petitioner has preferred this application for grant of regular bail in connection with Masaurhi P.S. Case No. 537 of 2025 dated 05.07.2025 registered for the offences punishable under Section 103(1) read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, during cricket match there was a clash occurred between two groups due to the decision of umpire. It is further alleged that the petitioner and the co-accused persons took out wickets and started beating Aman and Golu. Meanwhile, the co-accused, Rohit Patel fired on the chest of the husband of the informant due to which her

Thereafter, the co-accused Haider Ali and Roshan Kumar took out pistols from their waists and fired in the air and all of them ran away from there. The villagers took the husband of the informant to the hospital where the doctor declared him dead.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the member of mob. There is no specific allegation against the petitioner rather the specific allegation is against the co-accused Rohit Patel. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the witnesses, in para 7, 8, 12, 13, 96 and 97 of the case diary, have supported the case of the prosecution. As per the post-mortem report of the deceased the cause of death is due to fire arms injury.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.71651 of 2025(2) dt.16-10-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 537 of 2025.

7. The application stands allowed.
