JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with Magadh Medical P. S. Case No. 69 of 2019, disclosing offences under Sections 341, 323, 504, 506, 384, 120B, 34 of the Indian Penal Code.

As per F.I.R. informant purchased a piece of land from a power of attorney holder and it is said that petitioners demanded Rangdari of Rs.5,00,000/- from him while he was getting measurement of the land.

Submission of the learned counsel for the petitioners is that the land belongs to the father of the petitioner no.1, which has been purchased by the informant and there was an altercation between them, due to some dispute and this false and concocted case has been lodged by the informant. Further

Patna High Court CR. MISC. No.68978 of 2019(2) dt.04-11-2019 2/2 submission is that petitioners have no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-IV, Gaya, in connection with Magadh Medical P. S. Case No. 69 of 2019 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with the condition that they will not threaten the informant and his family members, otherwise, they are at liberty to move for cancellation of their bail bonds.
