Mr. Thakur, learned counsel appearing for the petitioner while referring to the prayer made in the writ petition seeking a direction to the respondents for appointment of the petitioner as Excise Constable, does admit that the petitioner failed to qualify in the educational qualification which in terms

Patna High Court CWJC No.6202 of 2017 (2) dt.25-07-2017 of the advertisement required that an applicant should be Intermediate as on 1.1.2015 and although this petitioner had obtained the said qualification prior to the said date having passed intermediate examination in 2014 vide Anenxure-1 but she in the process of upgrading her marks appeared in the next intermediate examination afresh which result was published only on 20.5.2015 which is beyond the cut-off date. In view of the position accepted by Mr. Thakur, learned counsel appearing for the petitioner himself no cause for indulgence is made out and the writ petition is disposed of accordingly.
