Petitioner apprehends his arrest in connection with Sahebganj P.S.Case No. 302 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 302, 504 of the Indian Penal Code and 27 of the Arms Act. Allegation against the accused persons, including the petitioner is of assault to the deceased, causing his death and petitioner was armed with sped.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him and he is 75 years old, which will appear from the impugned order itself. Heard learned APP also.
Having heard both sides and considering the fact that
Patna High Court Cr.Misc. No.44665 of 2018 (2) dt.01-08-2018 2/2 there is no overt act against the petitioner and he is aged 75 years, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge-I-cumAdditional Chief Judicial Magistrate-I, West Muzaffarpur, in connection with Sahebganj P.S.Case No. 302 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
