2. The petitioner apprehends his arrest in connection with Rohtas P.S. Case No.08 of 2021 instituted under Sections 147, 341, 323, 307, 427 of the Indian Penal Code and Sections 33, 41 and 42 of the Indian Forest Act.
3. As per the prosecution case, when the informant, who is a Forest Officer, was trying to bring the seized items to the Range Office then the petitioner along with named accused persons and 24-25 others came there with lathi and attacked on the forest guards causing injury to them and also damaged the government vehicles.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.73651 of 2023(2) dt.01-12-2023 2/2 petitioner is innocent and has falsely been implicated in this case. There is general allegation and no specific allegation is made against the petitioner. The petitioner has two criminal antecedents, which are under the Excise Act.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Rohtas P.S. Case No.08 of 2021, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) Harish/- U T
