The petitioners have prayed for bail in connection with K. Hat (Sahayak) P.S. Case No. 658 of 2019 registered for the offence punishable under Sections 272, 273 and 420 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, petitioners are indulged in business of illicit liquor.

It is submitted by learned counsel for the petitioners that petitioners are falsely implicated in this case on the basis of confessional statement of co-accused Vikash Kumar, who was apprehended on spot by the police. Nothing has been recovered

Patna High Court CR. MISC. No.65312 of 2019(2) dt.04-11-2019 2/2 from conscious possession of the petitioners. They have no criminal antecedent and are in custody since 07.09.2019. Having heard learned counsel for the parties and considering the fact that similarly situated co-accused Vikash Kumar has already been enlarged on bail, let the above named petitioners be released on bail on furnishing bonds of Rs. 10,000/- (Rs. ten thousand ) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge (Excise), Purnea in connection with K. Hat (Sahayak) P.S. Case No. 658 of 2019.
