2. The petitioner has preferred this application for grant of regular bail in connection with Maranga P.S. Case No. 272 of 2025 dated 08.08.2025 registered for the offences punishable u/ss 143, 145, 144, 64, 70, 61(2) read with Section 3(5) of the B.N.S., Sections 3, 4, 5, 6 of the Immoral Trafficking (Prevention) Act, Sections 4, 6, 8, 12 and 17 of the POCSO Act and Sections 75 and 79 of the Juvenile Justice Act and Sections 3(2)(v)(va) of the SC/ST Act.

3. As per the prosecution case, on 08.08.2025, police

Patna High Court CR. MISC. No.71792 of 2025(2) dt.01-11-2025 2/3 received an information that some major and minor girls were being forced into prostitution at Harida Bazar, N.H. 31. Thereafter, a police team conducted a raid under the supervision of the Superintendent of Police, Purnia. During the raid, nine men and three women were apprehended from the spot. One rescued minor stated that she had been lured from Muzaffarpur on a promise of a job and was later forced into prostitution by Munni Khatoon and Samina Khatoon, who beat her and took her earnings. Several other girls were also being exploited by the accused persons. On inquiry, one of the apprehended accused persons disclosed his name as Shamim Ahmad (petitioner). Further, the apprehended persons disclosed that they came there for making physical relation after paying the amount and some persons also stated that they are involved in the said offence.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this merely on suspicion. There is no specific allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Maranga P.S. Case No. 272 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
