JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioners apprehend their arrest in connection with Sursand P. S. Case No. 99 of 2019 registered under Sections 323,324,341,354, 379 and 504/34 of the Indian Penal Code. Allegation against the petitioners is that petitioners entered into the house of the informant and outraged her modesty.
Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case inasmuch as both parties are co-villagers and neighbour and there is case and counter case in between the parties inasmuch as Sursand P.S.Case No. 101 of 2019 has been lodged by the petitioner no. 1 against the informant and her family members and both the incidents have taken place on the same day.

No.65274 of 2019(2) dt.04-11-2019 2/2 Having regard to the submissions made by the parties and taking into consideration the fact that both parties are neighbour and there is case and counter case in between the parties, accordingly, I am inclined to grant anticipatory bail to the petitioners.
Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Mr. Kabindra Kumar, J.M., Pupri at Sitamarhi in connection with Sursand P.S.Case No. 99 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
