The petitioner seeks bail in connection with K. Hat (Sahayak) P.S. Case No. 658 of 2019 registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Considering the fact that there is no recovery from the conscious possession of the petitioner rather the same has been recovered from the house in which there are many tenants and the petitioner has not criminal antecedent.

Learned counsel for the petitioner submits that other co-accused persons have been granted bail on 17.10.2019 vide Cr. Misc. No.65943 of 2019. Learned counsel for the petitioner

Patna High Court CR. MISC. No.65409 of 2019(2) dt.05-11-2019 2/2 further submits that the petitioner is implicated in other case vide Maranga P.S. Case No.160 of 2018 under Sections 272, 273 of I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II cum Special Judge (Excise), Purnea in connection with K. Hat (Sahayak) P.S. Case No. 658 of 2019.
