The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, allegation against this petitioner is that he hit the buffalo of the informant by tractor due to which the buffalo got injured, on account of which altercation took place. All the accused persons including petitioner assaulted the informant and this petitioner also took cash of Rs. 30,000/- from the pocket of one Obaidullah Ansari. It is submitted that while the petitioner was returning home by tractor and by mistake hit the buffalo of informant and

Patna High Court CR. MISC. No.2248 of 2023(3) dt.03-07-2023 2/2 due to that reason scuffle took place between the parties in which both sides sustained injuries. There is case and counter case. The doctor has found the injury sustained by the informant simple in nature. Allegation of snatching cash is super addition to the make the case grave. Petitioner claims clean antecedents. Counsel for informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Jogapatti P.S. Case No. 280 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
