JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1095 (C) of 2016, disclosing offences under Sections 420, 465, 471, 120B of IPC. As per complaint case, the complainant has got a piece of land from one Dina Nath Mahto and he has constructed the boundary over the same as he has gone to construct the house but the same has been protested by the petitioners that they have already purchased the same in the year 2002 itself. Submission of the learned counsel for the petitioner is that even according to the narration of the F.I.R. it is a dispute in the nature of civil between the parties. Both the parties are agnates also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Bettiah, West Champaran, in connection with Complaint Case No. 1095 (C )of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
