Petitioner apprehends his arrest in connection with Laheri P.S. Case No. 255 of 2017 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. Allegation as per F.I.R. of theft in dwelling house. Submission of learned counsel for the petitioner is that petitioner is not named in the F.I.R. rather his name transpires during the course of investigation. Submission of learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner and he has been falsely implicated at their instance of his cousin brother in another cases also. Heard learned A.P.P., who opposed the payer for bail Petitioner has criminal antecedent also and he has accused in three

Having heard both sides and in the facts and circumstances and criminal antecedent against the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on record.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
