====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363,366A/34, of the Indian Penal Code and sections 8 and 12 of Protection of Children from Sexual Offences Act.

3. As per First Information Report, on 14.6.2023 at about 8.30 PM daughter of informant went to attend call of nature with her mother. When they reached near the village, this petitioner along with co-accused kidnapped her for the purpose of marriage.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. F.I.R. has been lodged after inordinate

Patna High Court CR. MISC. No.73122 of 2023(5) dt.03-07-2024 2/2 delay of 5 days without any explanation which renders the entire prosecution case doubtful. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail. He submits that the witnesses have also supported the prosecution case during course of investigation.
