The petitioner apprehends his arrest in a case registered for the offences punishable under Section 323, 324, 341, 307, 379 & 504/34 of the Indian Penal Code. The accusation is that when the informant was proceeding to a temple, petitioner and other accused persons surrounded him variously armed with lathi, danda, farsa, Chhura and Kanhayee Rai abused him and ordered to kill him. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Earlier vide order dated 12.12.2019, injury

Patna High Court CR. MISC. No.65700 of 2019(5) dt.04-03-2020 2/2 report of the victim was called for but the Superintendent of Police, Saran at Chapra vide his letter dated 12.12.2019 has informed that victim was not admitted in any hospital nor there is injury report. He has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-VII, Saran at Chapra in connection with Derni P.S. Case No. 18 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
