JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Vaishali P. S. Case No. 177 of 2019, disclosing offences under Sections 147, 148, 149, 323, 324, 307, 504, 506 and 427 of IPC.

As per F.I.R. there is allegation against the petitioner of assaulting the mother of the informant by lathi, causing injury to her.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties. The occurrence took place due to petty dispute of handing over the love letter of the daughter of informant and there is no repeated blow.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that injuries are grievous in nature, which is on the head of the mother of informant.

No.64603 of 2019(2) dt.16-10-2019 2/2 Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
