The petitioners apprehend their arrest in connection with Khagaria P.S. Case No. 600 of 2018, registered under Sections 341, 323, 308, 504, 506 and 379/34 of the Indian Penal Code. The accusation is that informant, Rahul Kumar, along with his nephew was present at grocery shop. At that time, Amol Kumar (petitioner no.2) came and dashed his nephew. When the informant made protest then he replied that earlier he had also dashed his vehicle, on which, petitioner no. 2 started to cause assault to him through fist and slaps. On next day, 01.09.2018, in the way, Abhay Kumar Singh, Sonu Kumar (petitioner no.3) and Pradeep Kumar

Patna High Court CR. MISC. No.64144 of 2019(2) dt.21-10-2019 2/2 (petitioner no.1) started to abuse and caused assault to the informant through lathi and iron rod causing injury at his head but anyhow informant fled away from there. Thereafter, they again came at his house and also caused assault to his sister, Priyan Kumari and Anmol Kumar (petitioner no.2) snatched gold chain from her neck. Learned counsel for the petitioner submits that petitioners are the neighbour of the informant and due to some dispute, scuffle took place, in which, informant sustained slight injury but with ulterior motive, the present case has been lodged with false allegation. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 600 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
