The petitioner is apprehending his arrest in connection with Bithan P.S.Case No.16 of 2017 registered for offences punishable under Section 364 of the Indian Penal Code.
Allegation against the petitioner as per FIR is that he is brother-in-law (Bahnoi) of the 'Sala' of the informant and kidnapped the son of the informant and thereafter forcibly married with a lady.
Submission of the learned counsel for the petitioner is that he is relative of the boy and he has been falsely implicated in this case and earlier there was a talk of marriage between the boy and the girl.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.45141 of 2018 (2) dt.02-08-2018 2/2 bail stating that the petitioner is named in the statement recorded under Section 164 C.R.P.C.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the.
